1. Acceptance of Terms

By accessing or using the website at lagunahillsasphaltpaving.com or by engaging Laguna Hills Asphalt Paving for any service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.

These terms apply to all visitors, customers, and others who access or use our website or hire us for services. We reserve the right to update these terms at any time. Continued use of our website or services after any update constitutes acceptance of the revised terms.

2. Description of Services

Laguna Hills Asphalt Paving provides asphalt paving, sealcoating, parking lot maintenance, driveway paving, pothole repair, crack sealing, asphalt resurfacing, grading and excavation, concrete curbing, drainage solutions, and related services to residential and commercial customers in Laguna Hills, CA and the surrounding South Orange County area.

We reserve the right to decline any project or service request at our discretion. Acceptance of a service request occurs only upon our written or verbal confirmation and, where applicable, execution of a written agreement.

3. Estimates and Pricing

All estimates are provided in good faith based on the information available at the time of the estimate. Estimates are not binding contracts. Final pricing may vary from an estimate if site conditions differ from what was observed or described during the estimating process, if the scope of work changes at the customer's request, or if unforeseen conditions are discovered once work begins.

Any changes to the scope of work that affect the project cost will be communicated to the customer before additional work is performed, to the extent reasonably practicable. Verbal approvals for additional work may be accepted in the field when written approval is not possible.

Estimates are valid for 30 days from the date issued, subject to changes in material costs, labor availability, or other factors outside our control.

4. Scheduling and Cancellation

Scheduled jobs may be postponed or rescheduled by either party due to weather conditions, equipment availability, or other factors. We will provide as much notice as possible if we need to reschedule.

If you need to cancel or reschedule a confirmed appointment, please contact us as soon as possible at (619) 349-6439 or contact@lagunahillsasphaltpaving.com. Cancellations made less than 24 hours before a scheduled start time may result in a cancellation fee to cover mobilization and material costs already incurred.

The customer is responsible for ensuring that the work area is accessible, clear of vehicles and obstructions, and ready for the crew on the scheduled start date. If the area is not accessible, we may need to reschedule, and mobilization costs may apply.

5. Payment Terms

Payment terms will be set out in your written estimate or agreement. In general, a deposit may be required to secure scheduling for larger projects. The remaining balance is due upon completion of work unless otherwise agreed in writing.

Accepted payment methods will be communicated to you at the time of your estimate. Invoices that are not paid within the agreed timeframe may be subject to a late payment fee. If collection efforts are required, the customer may be responsible for reasonable collection costs including attorney fees, to the extent permitted by applicable law.

6. Customer Responsibilities

The customer is responsible for:

• Providing accurate information about the project site and existing conditions.
• Ensuring that all necessary permits and HOA approvals are obtained prior to work beginning, unless the customer and contractor have agreed in writing that the contractor will handle permitting.
• Keeping the work area clear of people, pets, and vehicles for the duration of the job and during the curing period after completion.
• Notifying us of any underground utilities, irrigation lines, or other subsurface features near the work area.

7. Warranty Disclaimers

Laguna Hills Asphalt Paving will perform all work in a professional and workmanlike manner using industry-standard materials and methods. Any warranty on workmanship or materials will be stated specifically in the written project agreement for that job.

Asphalt and related paving materials are subject to natural weathering, UV degradation, soil movement, and other environmental factors that are outside our control. Normal maintenance, including periodic sealcoating, is the responsibility of the property owner. Cracking or settling caused by soil movement, poor drainage conditions, or lack of maintenance after project completion is not covered under any workmanship warranty.

The website and its content are provided "as is" without any warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Laguna Hills Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of this website or our services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from a service engagement shall not exceed the amount paid by the customer for the specific service giving rise to the claim. This limitation applies to all causes of action in the aggregate, including breach of contract, negligence, strict liability, and any other legal or equitable theory.

9. Intellectual Property

All content on this website, including text, images, logos, and graphics, is the property of Laguna Hills Asphalt Paving or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this site without our prior written permission.

10. Dispute Resolution

In the event of a dispute arising from or related to our services or these terms, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved informally within 30 days of written notice, either party may pursue available legal remedies.

Nothing in these terms prevents either party from seeking immediate injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect that party's interests.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising from or relating to these terms shall be brought exclusively in a court of competent jurisdiction located in California.
